1. How To Enter: Promotion begins 12:00 AM ET on 09/05/09 and ends 11:59 PM ET on 09/20/09, ("Promotion Period"). To enter visit www.AdamEve.com/nighstand ("Web site"), during the Promotional Period, and follow the online instructions to submit your entry by email. Complete the email entry, including but not limited to, your full name, date of birth and email address. All entries must be received by 11:59 PM ET, 09/20/09. All entries must include a valid email address since winner will be notified by email. Limit: one entry per person regardless of means of entry. No other forms of entry will be allowed except the one described above. All entries become the property of Adam & Eve ("Sponsor"), and will not be returned.
2. Eligibility: Sweepstakes is open to legal residents of the U.S. and District of Columbia (except residents of Puerto Rico, and where prohibited by law), 21 years and older at time of entry. Employees (and their immediate family and household members) of Sponsor and it's respective divisions, affiliates, subsidiaries, advertising and promotion agencies and all other entities or individuals associated with the development, administration, or fulfillment of this promotion (collectively, "Sponsor, et al") are not eligible to enter.
3. Drawing: The name of a potential Prize Winner will be selected within 10 days after the Sweepstakes Period ends from all eligible entries received during the Sweepstakes Period. The odds of winning depend on the number of eligible entries received. Potential winner will be notified by email within seven (7) days of the drawing by email. Prize winner will be required to reply to the email within fourteen (14) days of prize notification or prize will be forfeited and awarded to another potential winner. Prize will be awarded provided there are a sufficient number of eligible entries.
4. Prizes/Odds of Winning: Prize: One (1) Prize: Winner will be awarded all 15 items in the photograph on the contest page, no requests for prize substitutions awarded. If winner cannot accept prize as stated, prize will be forfeited in its entirety and an alternate winner will be chosen. Total value of all prizes: $350. Prize is not transferable or substitutable, except by Sponsor with one of equal or greater value. Prize is not redeemable for cash. Winner is responsible for all federal, state, and local taxes and all other costs and expenses not specifically stated above.
5. Internet: Sponsor, et al. are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions; phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties; other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion nor for illegible, unintelligible, late, lost or stolen entries or entries that cannot for whatever reason be downloaded or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human errors which may occur in the processing of any entries in this promotion. Persons found tampering with or abusing any aspect of this promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the promotion is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the promotion, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the promotion and conduct the Prize random drawing to select potential winner from among all eligible entries received as of the date of its termination of the promotion and all other daily prizes as of termination will not be awarded. Any personally identifiable information collected during your participation in this promotion will be collected by Sponsor and used by Sponsor and or its agents solely for purposes of the proper administration and fulfillment of the promotion as described in these Official Rules and as set forth in Sponsor's privacy policy at www.adamandeve.com. This information may also be used by Sponsor, for promotional and marketing activity purposes and as stated in their respective privacy policies. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
6. Consumer Disclosure/Award Rules: In the event of inadvertent errors in the structure of, or printing of materials used in connection with, this sweepstakes, Sponsor reserves the right to terminate or amend this sweepstakes, in whole or in part, without prior notification and with immediate effect. In any such event, prize may be awarded based on entries received prior to date of termination or amendment.
7. General: Void outside the U.S., PR, and where prohibited by law. By entering this promotion, entrants agree to abide by these Official Rules. All federal, state, and local laws and regulations apply. By entering winners agrees that his/her name, photograph, videotape, likeness or statement may be used for advertising and publicity purposes in any media as Sponsor and its agents so determine without any further compensation, except where prohibited by law. Any entry blanks or other materials that are incomplete, illegible, altered, counterfeited or tampered with or obtained other than through legitimate and authorized sources are void and Sponsor, et al, shall not be responsible for illegible, damaged, lost, late, stolen, incomplete, undelivered/undeliverable or misdirected entries. SPONSOR MAKES NO, AND DISCLAIMS ALL, WARRANTIES WHETHER EXPRESS OR IMPLIED, REGARDING ANY PRIZE AWARDED IN THIS PROMOTION. By participating, Winner releases Sponsor, et al. and their from any and all liability, whether personal or property, whether directly or indirectly, for all injuries, losses or damages of any kind (including death) arising out of, or in connection with the possession, acceptance, enjoyment, use/misuse of any Prize or arising out of participation in this promotion. Entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this sweepstakes arising from your entry, participation or acceptance of any prize, you indemnify Sponsor, et al., their directors, officers, employees and agents from any and all such claims, including attorneys’ fees related thereto. The laws of the State of North Carolina shall govern the interpretation of these Official Rules. Any and all disputes will be resolved in the appropriate courts in the State of North Carolina exclusively, and subject to the laws of the State of North Carolina. Should there be a conflict between the laws of the State of North Carolina and any other laws, the conflict will be resolved in favor of the laws of the State of North Carolina.
